
SENATE CONCURRENT RESOLUTION NO. 9

Requesting the Joint Committee on Government and Finance conduct a
study to review the effect of transferring the statutory
provisions governing the real estate commission from chapter
forty-seven of the code of West Virginia to chapter thirty of
said code with other state professional and occupational
licensing boards.

Whereas, The Legislature is charged with protecting the public
interest in the practice of many occupations and professions; and

Whereas, The state regulates and monitors the practice of
professions through licensing boards, which are, in turn,
responsible for ensuring the certification of those professionals
practicing in the profession being regulated; and

Whereas, There is concern within the real estate community
that transferring the provisions governing the commission might
result in difficulty for full compliance with all laws and rules
governing a professional board; and

Whereas, It is the desire of the Legislature to afford all
interested parties the opportunity to offer their ideas, advice and suggestions so that such a transition, if considered advisable by
the Legislature, will cause the least amount of concern and
confusion to the public and to the commission; therefore, be it

Resolved by the Legislature of West Virginia:

That the Joint Committee on Government and Finance is
requested to study the possibility of transferring the provisions
governing the real estate commission from chapter forty-seven of
the code of West Virginia to chapter thirty of said code, with
specific emphasis on the discrepancies including membership,
meetings, notification of rules, fee collection, licenses,
continuing education, jurisdiction of appeals and rosters that
might occur with any transfer; and, be it

Further Resolved, That the Joint Committee on Government and
Finance report to the regular session of the Legislature, 2002, on
its findings, conclusions and recommendations, together with drafts
of any legislation necessary to effectuate its recommendations;
and, be it

Further Resolved, That the expenses necessary to conduct this
study, to prepare a report and to draft necessary legislation be
paid from legislative appropriations to the Joint Committee on
Government and Finance.
